H. WILLIAM EDGAR: There are two types of child custody, legal and physical custody. Legal custody is the decisions relating to health, education, and welfare of a child.
There is physical custody, who actually has physical custody of the child. In California, there is a presumption for joint legal custody. Both parents shall share in the rights and responsibilities of raising the children. And both parents shall have frequent and continuing contact with the children.
There are some exceptions to that rule, including whether or not there's been domestic violence, whether or not a parent has problems with alcohol or drugs.
