Air Force Family-Support Requirements During Separation

An Air Force family may need a support arrangement while separation and court proceedings are still being sorted out. Start by separating three questions: what is owed, what has actually been paid, and what process can make future payments dependable.

How the interim amount is calculated

DAFI 36-2906, Chapter 4, uses the applicable nonlocality BAH with-dependents rate divided by the number of supported family members to determine a per-person share when no applicable support agreement or order fixes the obligation. It does not use the full locality housing allowance as the starting amount.

The family count has exclusions, including a former spouse and a current spouse on active military duty. Children supported under another order can still affect the count. An authorized release from the instruction’s spousal-support requirement does not release a member from court-ordered support.

Why an LES alone does not answer the question

A recent Leave and Earnings Statement is useful, but the net deposit does not establish either the interim calculation or the California support result. Assemble several months of statements where available. Identify changes in allowances, bonuses, deductions, and any other income rather than treating every pay period as identical.

The other parent’s income and the children’s parenting schedule also belong in the California review. A military administrative calculation should not replace complete financial disclosure or a properly prepared support request.

Present the payment problem with records

A practical request should identify the family members seeking support, the separation date, housing circumstances, existing orders or agreements, and the payment history. List direct payments separately from amounts transferred to the spouse. Keep copies of communications and receipts.

If the parties reach a temporary arrangement, document the amount, due dates, payment method, and treatment of direct bills. Avoid vague language such as “continue paying the usual expenses” when the meaning of those expenses is already disputed.

Coordinate the California case

A support plan should address the period before a hearing and the arrangement that follows a court order. Review whether temporary relief is needed, which financial documents are missing, and how payments will be recorded so that a later arrears dispute can be evaluated accurately.

Use the instruction that applies to this member

DAFI 36-2906, incorporating Change 1 dated March 31, 2025, addresses family support and explains its coverage. Service component and duty status should be checked rather than assuming every person working on an Air Force installation is covered in the same way.

The instruction’s support calculation also requires the correct supported-family count and applicable nonlocality rate. The current version and any controlling agreement or order should be identified before promising a monthly figure.

A direct housing payment needs an explanation

Suppose the member continues paying the landlord while the separated spouse receives a smaller transfer. Both payments should appear in the accounting. Whether the housing expense satisfies part of the applicable requirement depends on the governing instruction and any agreement or court order.

This is especially important because an LES, a bank deposit, and a rent receipt each show different parts of the transaction. Present the complete facts before concluding that the family received nothing or that the obligation was fully satisfied.

How the California request differs

The California court does not simply adopt the Air Force interim figure. The parties’ income, legally recognized deductions, parenting circumstances, and the relief requested require a separate presentation.

An administrative release from an instruction’s requirement is also not a modification of an existing judicial award. If the court-ordered amount needs review, address that through the appropriate court procedure while maintaining an accurate record of what was due and what was paid.

Common questions from Air Force families

Is the locality BAH amount the same as the instruction’s starting rate? The nonlocality rate described in the instruction should be distinguished from the housing amount appearing in the member’s particular pay circumstances.

Can family composition change the calculation? Yes, the applicable supported-family definitions and exclusions need to be applied to the actual family. A figure calculated for one household arrangement should not simply be reused for another.

Does an administrative release change a judicial support order? A release under the instruction and a court modification are different acts. The judicial obligation must be addressed through the proper court process.

What if the parties disagree about credit for housing? Record what was paid and identify the controlling rule, agreement, or order. The current instruction’s treatment of indirect support needs to be considered before assuming every housing expense counts in the same way.

A good interim arrangement should make the amount and credits understandable. The California proceeding should then address the appropriate judicial award with the required financial evidence. When duty or household circumstances change, the parties should know what must be recalculated administratively and what requires a court request. That distinction can prevent an avoidable balance from building while each side believes a different amount governs.
