Coast Guard Family-Support Requirements During Separation

A Coast Guard family seeking support should verify the Coast Guard’s own policy and payment procedures. An article describing another military branch may use a different calculation or send the request to the wrong pay office.

The published interim scale

The Coast Guard uses a monthly interim support scale in disputed cases when a court order does not specify support. The scale sets an administrative minimum while the parties work toward an agreement or court order. Coast Guard Discipline and Conduct manual, COMDTINST M1600.2, § 2.E.3.c, p. 2-29

For a spouse alone, add 20% of basic pay to the BAH difference. For a spouse with one qualifying child, add 25%. For a spouse with two or more qualifying children, add 30%.

For children alone, the scale uses basic pay. The amount is one-sixth for one qualifying child, one-quarter for two, and one-third for three or more. The child categories cover minor children and children with disabilities as described in the manual.

For this scale, subtract the member’s without-dependents BAH rate from the member’s with-dependents rate. Use that difference for the spouse categories. BAH-DIFF is a separate allowance with its own rules. A California court determines support under California law.

Command action and payment collection differ

The manual provides for command counseling and potential administrative or disciplinary consequences for nonsupport. It also explains that command involvement does not itself give unrestricted authority to redirect the member’s federal pay. A request to the command should not be treated as completed garnishment paperwork.

Assemble the supporting documents

Identify the member’s unit, the family relationship, where the children live, any existing order or agreement, and the payment history. Keep direct transfers, direct housing payments, and other expenses in separate categories. Record the amount actually received and the date received.

If there is a dispute about past payments, preserve bank records and receipts before trying to resolve it through summaries or recollections. The documents should let someone unfamiliar with the family reconstruct what happened each month.

Prepare the California support case

California support requires an independent evaluation of the parties’ finances and the applicable legal standards. A branch’s interim percentage does not substitute for that analysis. The attorney should also determine the appropriate court procedure and how any eventual order will be implemented through the correct pay system.

A workable arrangement should identify the obligation, the method of payment, and how direct payments will be treated. Edgar & Dow can review the California issues and coordinate the support documentation so that a military inquiry and a court request rest on the same accurate financial record.

Why a Coast Guard case needs the correct pay channel

The Coast Guard’s administrative structure and pay procedures should not be assumed to match DFAS processing for another branch. The member’s pay status, the obligation, and the correct receiving office need to be identified before submitting collection documents.

A command complaint and a garnishment request do different work. Sending one does not necessarily complete the other. The family should know which action is intended to address compliance and which action is intended to collect a court-ordered amount.

Treat housing figures carefully

A current housing allowance, the difference between with-dependent and without-dependent rates, and the separately named BAH-DIFF allowance are not interchangeable figures. The applicable directive and family circumstances should establish which figure belongs in an administrative calculation.

The California court’s income analysis is separate. A housing-related figure excluded from a branch formula does not automatically disappear from the support calculation, and an administrative percentage does not establish a judicial maximum.

An example of a payment dispute

If a member pays a mortgage but the spouse receives no cash transfer, the ledger should show both facts. The parties then need to determine how that expense is treated under the actual order, agreement, or applicable administrative rule.

The most useful result is a defined obligation with clear due dates and credit rules. It gives the recipient a practical basis for identifying a shortfall and gives the member a dependable record of compliance. The Coast Guard directive and any current implementing guidance should be confirmed before applying a numerical interim scale to a particular family.

Common questions from Coast Guard families

Can another branch’s support scale be used as a shortcut? The Coast Guard policy and the member’s circumstances should be examined directly. A familiar Army or Navy example may use a different pay base or family category.

Does BAH difference mean the same thing as BAH-DIFF? The terms should not be substituted without examining the governing directive. Similar names can refer to different figures and produce a different calculation.

Does a command inquiry establish garnishment? Command assistance and legally effective collection are separate processes. Identify the correct pay office and legal requirements for the requested action.

What if a court order already exists? Read what it covers and evaluate the Coast Guard requirement in that context. The administrative scale should not be assumed to replace the judicial amount or create a second amount on top without a legal basis.

A useful consultation should translate those questions into a specific plan. The family needs to know what can be requested immediately, what evidence supports the claim, and how any court-ordered payment will be implemented. An uncertain administrative figure should not be presented as a guaranteed California result. Clear definitions and the correct procedure are more helpful than an apparently precise number calculated under the wrong policy.
